Disclosure of risks, release, and authorization

INDIVIDUAL – FAMILY

This form applies between the CHU Sainte-Justine Foundation (the “Foundation”) and me, on my own behalf and/or in my capacity as the parent or guardian of a minor child.

For the purposes hereof,

  • The “Participant” refers to the signatory and the minor(s) indicated at the bottom of this form, whom I declare to be under my parental authority or legal guardianship, as the case may be.
  • The “Event” refers to RBC race for the kids, taking place at Parc Jean- Drapeau (Circuit Gilles-Villeneuve) on October 5th 2024, including event-related preparations and post-event activities (e.g., cocktail parties, dinners, gatherings).

Risk disclosure and acceptance

  1. It is acknowledged and agreed that:
    1. the Participant is physically able to participate in the Event and has no pre-existing condition that would limit their participation;
    2. where applicable, the Participant’s equipment is mechanically adjusted and adapted to its intended use;
    3. the Event involves a number of foreseeable and unforeseeable risks and dangers, some of which are inherent to the nature of the Event, the use of Event-related equipment or facilities, weather conditions at the time of the Event, and the actions of Event participants;
    4. the Participant may suffer bodily, moral, or material injury while taking part in the Event.
  1. The Participant freely and voluntarily accepts and acknowledges the following:
    1. the Participant assumes sole responsibility for all risks and dangers directly or indirectly associated with their involvement in the Event;
    2. the Participant must hold all necessary insurance related to their participation in the Event, covering any bodily, moral, or material injury that the Participant or any other person or entity may incur as a result of the Participant’s involvement in the Event, or must otherwise personally assume all costs resulting from such circumstances.

Release of liability

  1. The Participant understands that the Foundation and its directors, officers, employees, volunteers, promoters, independent contractors, sponsors, partners (including Royal Bank of Canada), subcontractors, agents, and assigns (collectively, the “Released Parties”) will take the necessary security measures to ensure that the Event runs smoothly, including the deployment of an emergency plan by a specialized firm if necessary, but assume no liability whatsoever for any damages or bodily or moral injury incurred by the Participant.
  1. Consequently, the Participant hereby indemnifies the Released Parties and waives their right to all remedies, lawsuits, claims, causes of action, damages, costs, and expenses, including legal fees and costs, of any nature whatsoever, against the Released Parties in respect of any bodily, moral, or material injury that the Participant may incur in connection with the Event.
  1. In addition, the Participant agrees to indemnify, defend, and hold harmless the Released Parties from and against all actions, lawsuits, claims, causes of action, damages, costs, and expenses, including legal fees and costs, of any nature whatsoever, arising from the Event.

Obligations of the Participant

  1. The Participant must:
    1. show respect and consideration for their own safety and that of the other participants, as well as for their own property and the property of others;
    2. respect all guidelines and rules issued by the Foundation or its partners, as well as any rules issued by a government authority that apply to the Event.  Any Participant who does not comply with the guidelines or rules will be asked to leave and will not be reimbursed for any costs (registration or other).

Authorizations

  1. If the Participant is injured during the Event, the on-site personnel may intervene and, if necessary, call upon emergency services (e.g., paramedical and ambulance services).
  1. The Foundation and anyone appointed by the Foundation for this purpose are authorized to collect, record, and/or use the name, likeness, voice of the Participant, as well as any photos or videos of them, including content related to the Event posted by the Participant or by someone in their network on their personal social media accounts. This authorization includes all the rights necessary for the Foundation to use, reproduce, publish, broadcast, transmit, distribute, display, or exhibit said elements, in whole or in part, with or without the Participant’s name, individually or in combination with those of other people:
    1. for informational, educational, publicity, or promotional purposes;
    2. via various mediums, including in the Foundation’s internal or external communication tools, publications, multimedia productions, videos, exhibitions, or advertisements, and on its website, in traditional media (television, radio, newspapers, etc.), on social media (Facebook, Instagram, LinkedIn, etc.), or on its partners’ websites and/or social media sites;
    3. without payment or compensation of any kind, and without limitation as to format (paper or digital), territory, or language, and for an indefinite period of time, as of the signature date on this form.

The Participant releases the Released Parties from any and all liability related to the rights granted herein and acknowledge(s) that they are not responsible for any improper use by third parties.

By providing personal information to the Foundation or its authorized representatives, you consent to the Foundation’s collection, use, and disclosure of such information in accordance with applicable law, including for the purposes of and in the manner necessary for carrying out its mission and philanthropic activities.
